1. Acceptance of Terms
By downloading, installing, or using FactsPanel ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
FactsPanel is an iOS application that helps users create Supplement Facts labels formatted according to FDA regulations (21 CFR §101.36). The App provides tools for inputting nutritional data, calculating Daily Values, and exporting print-ready labels.
3. Regulatory Disclaimer
Important: While FactsPanel is designed to help create labels that comply with FDA formatting requirements, the App does not guarantee regulatory compliance. You are solely responsible for:
• Verifying that your label content meets all applicable FDA regulations
• Ensuring the accuracy of nutritional data you input
• Having your labels reviewed by a qualified regulatory consultant before use
• Complying with all federal, state, and local labeling requirements
FactsPanel is a formatting tool, not a regulatory compliance service.
4. Subscription and Payments
FactsPanel offers a subscription-based service ("FactsPanel Pro"). Subscriptions are processed through Apple's App Store and are subject to Apple's terms and conditions.
• Free Trial: New users receive a 7-day free trial
• Billing: Subscriptions renew automatically unless cancelled
• Cancellation: You may cancel at any time through your Apple ID settings
• Refunds: Refund requests are handled by Apple per their policies
5. User Responsibilities
You agree to:
• Provide accurate nutritional data for your products
• Use the App only for lawful purposes
• Not attempt to reverse engineer, modify, or distribute the App
• Not use the App to create misleading or fraudulent labels
6. Intellectual Property
The App, including its design, code, and content, is owned by FactsPanel and protected by copyright and other intellectual property laws. You retain ownership of any formulation data you input into the App.
7. Limitation of Liability
To the maximum extent permitted by law, FactsPanel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to regulatory penalties, product recalls, or business losses.
8. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or that it will meet your specific regulatory requirements.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of significant changes through the App or via email.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
